How long before foreclosure proceedings begin?

Once you’ve fallen delinquent and haven’t resolved default, foreclosure by advertisement can be scheduled. According to MSHDA (Michigan State Housing Development Authority):

  • The foreclosure process can start after a 120-day period of default. 
  • A Notice of Foreclosure Sale must be published for 4 consecutive weeks in the local newspaper, and posted on the property at least 14 days before the sale. 


Does my house have to be in good condition to list on the MLS to sell?

No — your house does not have to be in perfect condition to sell.
In Michigan, many homes in foreclosure sell “as-is,” meaning you don’t have to make repairs, clean everything up, or invest money you don’t have. You can still get offers even if the home needs work.

Buyers will factor the condition into their offer, but it won’t stop the home from selling AND Prime Real Estate Agency's job is to get you the most money possible. 


 What is the redemption period — how long do I have after the sale?

The redemption period is the time after the Sheriff’s Sale (public auction) during which you still technically own the property and can redeem it (pay off the amount owed) or sell it.
According to MSHDA:

  • The typical redemption period is 6 months for most residential homes. 
  • If the amount claimed to be due is less than 2/3 of the original loan (i.e., you owe less), then the redemption period can extend to 12 months.
  • For “farming property” or large acreage, it may also reach up to 12 months. 


Can I stay in my home during the process and during the redemption period?

Yes. MSHDA states that during the redemption period:

  • You can live in the home.
  • You are not required to make payments during the redemption period to the purchaser, but you must maintain utilities, insurance and keep up the property.


What rights does the purchaser (buyer at the Sheriff’s Sale) have during the redemption period?

  • The purchaser has the right to inspect the home (inside and out) with required notice. 
  • If you unreasonably refuse inspections, or you damage the property, the purchaser may begin eviction proceedings and terminate your redemption period early. 

What happens after the redemption period ends and I haven’t redeemed the home?

Once the redemption period ends and you haven’t redeemed or sold the property:

  • Ownership transfers to the purchaser (often the lender) through the deed.
  • If you’re still living in the home, you’ll receive a summons to appear in court for eviction. 

What should I do if I’m behind and don’t think I can save the home?

MSHDA recommends:

  • Contact a HUD-certified housing counselor (approved via MSHDA) as early as possible. 
  • Explore whether selling the home before the foreclosure or during redemption could protect equity and credit.
